1) Scope of Application
1.1 These Terms and Conditions (hereafter referred to as “GTC”) of BG Investment GmbH (hereafter referred to as “Seller”) govern all contracts established between a purchaser (hereafter referred to as “Client”) and the Seller concerning the products and/or services offered in the Seller’s online store. Any terms proposed by the Client that deviate from these GTC are expressly rejected unless otherwise mutually agreed.
1.2 By using the Seller’s website, the Client acknowledges and agrees to these GTC.
1.3 The Seller retains the right to modify these GTC at any time. Substantial amendments will be communicated to the Client at least 30 days in advance. Continuing to use the Seller’s online services after the updates take effect signifies the Client’s acceptance of the revised terms.
1.4 The Client consents to electronically review, sign, and authenticate relevant documents under the E-SIGN Act, the UETA, and applicable state laws in Illinois, New York, and Washington. The Client acknowledges that their electronic signature carries the same legal weight as a handwritten signature and that such documents may be stored exclusively in digital format as legally transferable records.
2) Formation of Contract
2.1 Product descriptions on the Seller’s website are not binding offers but serve as an invitation for the Client to submit a purchase request.
2.2 The Client can place an order via the online checkout process. By completing the checkout and confirming the order, the Client submits a legally binding offer for the selected products or services.
2.3 The Seller may accept the Client’s offer within five days through one of the following actions:

Sending an order confirmation in writing (via email or fax), with receipt of confirmation by the Client being decisive, or
-
Shipping the ordered products, with receipt by the Client being decisive, or
-
Requesting payment from the Client after the order has been placed.
If none of these actions occur within the specified timeframe, the Client’s offer is considered rejected.
2.4 The acceptance period for an offer begins the day after submission and expires at the end of the fifth day.
2.5 The Seller stores the contract details and will send them to the Client via email or other written means. The contract text is not accessible to the Client on the Seller’s website post-purchase.
2.6 Before finalizing an order, the Client can review and edit entered data using standard input methods.
2.7 English is the only available language for contract finalization.
3) Return Policy
We provide a 30-day return window, starting from the date of product receipt.
To initiate a return, please contact us at support@sportsoutdoorfunz.com.
If approved, we will provide a return shipping label and instructions. Items sent without prior return approval will not be accepted.
Returns are not available for sale items or gift cards.
To qualify for a return, items must be unused, in their original packaging, and accompanied by proof of purchase.

Damages and Issues
Please inspect your order upon delivery and report any damage or incorrect items immediately so we can address the issue.
Exceptions
Certain goods, including perishable items, custom-made products, personal care products, hazardous materials, or flammable liquids/gases, cannot be returned. Contact us for questions about specific items.
Refunds
Approved refunds will be processed to the original payment method within 10 business days. If you do not receive a refund within 15 business days, contact us at support@sportsoutdoorfunz.com.
4) Pricing and Delivery Fees
4.1 Prices on the Seller’s website are listed in US dollars, excluding applicable taxes and shipping fees, which are calculated separately.
4.2 Additional costs, including bank transfer fees, customs duties, or taxes, may apply to international orders and must be covered by the Client.
4.3 Payment methods available are listed in the Seller’s online store.
5) Shipping and Delivery Terms
5.1 Orders are shipped to the delivery address specified by the Client unless otherwise arranged.
5.2 If an item is unavailable, the Seller will notify the Client as soon as possible and may offer an alternative product or cancellation with a refund.
5.3 If delivery is unsuccessful due to the Client’s unavailability, the Client will be responsible for return shipping costs.
6) Warranty
The Seller disclaims any implied warranties of merchantability or fitness for a particular purpose regarding purchased products.
The Seller is not liable for indirect, special, consequential, or punitive damages, including lost profits. The Seller’s total liability is limited to the price paid by the Client for the purchased goods.
Some jurisdictions may not allow certain warranty exclusions, in which case these limitations apply only to the extent permitted by law.
7) Limitation of Liability for Website Use
7.1 The Seller’s website is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
7.2 The Seller is not responsible for any damage caused by viruses or harmful software resulting from accessing or downloading content from the website.
7.3 The Seller is not liable for third-party website content linked from the Seller’s site.
Some jurisdictions may not permit exclusions of implied warranties, so these limitations may apply only to the extent allowed by law.
8) Time Limit for Legal Claims
Any legal claims relating to this agreement must be initiated within 12 months from the date the claim could reasonably have been identified.
9) Governing Law
This agreement is governed by the laws of the state of Illinois, excluding the UN Convention on Contracts for the International Sale of Goods.
10) Jurisdiction
Any legal proceedings related to this agreement must be initiated in the courts located in the state where the Seller operates. Both parties consent to this exclusive jurisdiction.
